III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

— statement that, within the last 5 years, it has not had any legally effective judgment for perpetrating a crime as per Article 88, paragraph of the PPL (Public Procurement Law),

— certificate that there is no bankruptcy procedure opened by a competent authority,

— certificate that there is no liquidation procedure opened by a competent authority,

— certificate of paid taxes, contributions and other public dues issued by a competent authority in the country where the economic operator is registered,

— certificate from the Registry of Offences for Committed Crimes by Legal Persons that a secondary sentence for prohibition of participation on public bidding procedures or awarding of public procurement or public private partnerships contracts has not been issued against it,

— certificate from the Registry of Offences for Committed Crimes by Legal Persons, that a secondary sentence for provisional or permanent prohibition to execute a specific business activity has not been issued against it,

— certificate that there is no legally effective judgment imposing a misdemeanour sanction — prohibition to perform a profession, activity or duty, that is to say, temporary prohibition to perform a specific activity, imposed against it.

Document on registered economic activity: as a proof to establish the capability to perform a professional activity, the Contracting Authority shall request from each economic operator to submit proof that it is registered as a natural or legal entity performing the economic activity related to the subject matter of the public procurement contract or proof for belonging to the appropriate professional association as per the regulations of the country where it is registered.

List and brief description of selection criteria:

— by a list of main deliveries of goods or services rendered in the last 3 years, including values, dates, buyers (contracting authorities or economic operators),

— by a description of the technical staff and technical bodies that will participate in the execution of the public procurement, especially those responsible for quality control, and in case of public procurement of works, those involved in the performance of the works, regardless whether they are employed by the economic operator or not,

— by a description of the technical conditions and measures that the economic operator uses to ensure quality, as well as a description of its development and research capacities,

— by a statement on the instruments, plants or technical equipment that the service provider or contractor has at his disposal for performing the contract,

— valid ISO 27001:2013 Certificate.

Minimum level(s) of standards possibly required:

— list of archiving services rendered (digitalisation, description and inventory of documentation, selection and validation of archival material),

— statement that the economic operator is compliant with the requirements for processing of archival material as per the Law on Archival Material, Article 2: Items 1, 2, 5, 10, 11 and Article 34 (Official Gazette of RM No 95/12), Decree on office and archival operations, Article 45 (Official Gazette of RM No 1/14), Guideline on the manner of techniques of handling archival and documentary material in the office and archival operations (Official Gazette No 99/14),

— economic operator should provide proof of possession of adequate storage space for storage of non-conventional archival material specified in the Decree on office and archival operations (Article 45, Item 1),

— statement that the economic operator possesses or has at its disposal microfilm digitalisation equipment,

— valid ISO 27001:2013 Certificate.
